1. Agreement to Terms

These Terms of Service (“Terms”) govern your use of NenaFi LLC’s (“NenaFi”, “we”, “us”, “our”) website development, hosting, and related services. By engaging our services, you agree to be bound by these Terms.

2. Services

NenaFi provides the following services:

• Custom website design and development
• Domain name registration and management
• Email setup and configuration
• Website hosting and maintenance
• Technical support and updates

Specific service details, timelines, and deliverables will be outlined in your individual service agreement or project proposal.

3. Payment Terms

• Payment is due according to the payment schedule outlined in your service agreement
• All fees are non-refundable unless otherwise specified
• Late payments may result in service suspension
• We reserve the right to modify pricing with 30 days written notice
• You are responsible for all applicable taxes

4. Client Responsibilities

You agree to:

• Provide accurate and timely information needed for service delivery
• Respond to our requests for feedback and approvals in a reasonable timeframe
• Ensure all content provided is original or properly licensed
• Comply with all applicable laws and regulations
• Not use our services for illegal or harmful purposes
• Maintain your own privacy policy and terms of service for your website and business operations
• Ensure compliance with data protection laws applicable to your business and customers

Important: While NenaFi provides website development and hosting services, you are responsible for your own business legal compliance, including privacy policies, terms of service, and data protection requirements for your customers.

5. Intellectual Property

Upon full payment, you will own the final website design and custom code developed specifically for your project. However, NenaFi retains rights to any pre-existing code, frameworks, templates, or proprietary methodologies used. We reserve the right to showcase your completed project in our portfolio unless you request otherwise in writing.

6. Service Level and Support

• We aim to maintain 99.9% uptime for hosted websites
• Support requests are typically addressed within 1-2 business days
• Emergency support may be available for critical issues
• Ongoing maintenance and updates are included as specified in your service plan

7. Limitation of Liability

To the maximum extent permitted by law, NenaFi’s liability for any claims arising from our services shall not exceed the total amount paid by you for the specific services in question. We are not liable for any indirect, incidental, special, or consequential damages.

8. Termination

Either party may terminate services with written notice. Upon termination, you will receive all completed deliverables you have paid for. Recurring services will continue until the end of the current billing period.

9. Privacy

Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Texas, without regard to its conflict of law principles. Any disputes shall be resolved in the courts of Texas.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes by email or through our website. Continued use of our services after changes constitutes acceptance of the new Terms.
